What many employers do not realize is that BQs are considered a selection procedure (i.e., test) and when they result in adverse impact, employers are required to provide evidence concerning the validity of BQs.

According to the Internet Applicant Regulations, defensible (i.e., valid) BQs must meet the following three conditions: (1) noncomparative, (2) objective and not depend on subjective judgment, and (3) relevant to the performance of the particular position and enable the employer to accomplish business-related goals. This presentation will provide guidance to employers on how they can develop BQs that are likely to survive scrutiny from government enforcement agencies (e.g., EEOC).
